Questions from lawyers (Overlawyered) to lawyers (John Edwards & Fred Baron)



Overlawyered's Walter Olsen does the useful service of Coordinating the Edwards Story.

Overlawyered's been asking questions that the MSM should have been asking of lawyers--not associated with the Edwards' campaign--for the last nine months and longer. One such article: Fred Baron’s version of the Rielle Hunter payments
. In it, Ted Frank asks two reasonable questions:

* When did Andrew Young stop working for Edwards, and why?
* How did Young and Hunter afford those nice homes in North Carolina to begin with?

And while we're on the subject, here's a question for Overlawyered; it comes from DBKP reader, liamd:

Lawyers for Hunter and Young both claimed Young was the father. If it turns out …. surely it will…that Edwards is the dad, any consequence for the lying lawyers? Or can they just lie as long as they are not under oath? Anyone know?

Enquirer Gave the MSM "Cooties"

Now that it's okay for the MSM to discuss the John Edwards scandal, Kelly Corbiella, of CBS News, asks, "How Did A Supermarket Paper Beat Other News Media To The Biggest Political Scandal Of The Day?"


"...Cobiella asked, if this is such scoop, and this was first out several [ED NOTE: nine] months ago, why didn't others pick up on it?"

Kurt Anderson, a media analyst and contributing editor at New York Magazine, said, "That is the sixty-four thousand million dollar question, isn't it?

"The National Enquirer gives the story cooties for all the Times and Boston Globes, the Washington Posts of the world. That is partly because thirty years, forty, fifty years ago, the National Enquirer was very different than today. It is this low-brow celebrity scandal-mongering thing."


Corbiella also quotes David Perel, of the Enquirer, on Elizabeth Edwards' involvement:

"Stop, stop. I don't want to go there. I do not like it," Perel said to a reporter's suggestion about the Elizabeth Edwards angle. "She's been hurt, she's lashed out."

"So there is such a thing as 'untouchable'?" Cobiella asked.

"Just some places you don't go," Perel told her. "And there's some places I don't want to go. And in this case we really have tried to stay away from that aspect of the story.

"I want to hit the news element of the story. I want to hit the fact that a man running for president had an affair and then lied about it to the American public and, you know, darn near blew up his own political party while doing it."


Of course, the Enquirer's been busy enough with tracking mistress, Rielle Hunter's movements, money trails and every other aspect of the scandal--months ahead of everyone else in Big Media.

Sally Kalson, Pittsburgh Post-Gazette, starts to ask some uncomfortable questions and make a few equally-uncomfortable observations, What were the Edwards thinking? John Edwards was courting public suicide -- and his wife helped him.

People's marriages are their own business. If Mr. Edwards in 2006 had an extramarital affair, or worse, with a younger woman who made videos for his campaign and if his wife forgave him, that's for their family to deal with. But what in blazes was the man doing running for president with this time bomb in his hip pocket? And what was Elizabeth Edwards thinking when she encouraged him, made speeches for him, touted the strength of their marriage in the face of adversity as an indicator of his fitness for office, knowing that he'd cheated on her?

It may seem mean-spirited to pose that question about a wronged woman fighting cancer, especially one who was so brave and determined on the campaign trail. But as a fellow survivor, I claim a little leeway.

The disease may give you a pass in some areas. Chemo-brain is a legitimate excuse for forgetting things and making mistakes. Thoughts of your own mortality may cloud your judgment and crowd out other concerns. They also might make you desperate to achieve a long-held dream while there's still time.

This last point may explain how Mrs. Edwards could have gone out on the campaign trail on her husband's behalf, knowing what she knew, exhorting voters to believe in him as she believed in him. But even in separating his infidelity from his fitness for office -- and she's certainly not the first wife to have done that, as Hillary Clinton can attest -- she must have known they were playing with fire.

Kalson wraps up her excellent story with:

Early in the primary, when the couple announced that Mrs. Edwards' cancer had returned, some in the media pressed hard on how they could forge ahead with such an all-consuming undertaking. Turns out it was the right question, but based on the wrong premise.

This isn't the first time the media missed an essential part of the story, and it won't be the last time a politician self-destructs this way. More's the pity on both counts.

Words from a Clear-Eyed Liberal Mouth

Sad to say, it SHOULD BE a journalist's wet dream...because it appears that, yet again, the MSM is letting bloggers like Deceiver and Death By A Thousand Paper Cuts do the leg work. Even more appalling is when MSM writes about it, and then fails to properly attribute their sources. Come on guys, you know better than that. You're not some rinky dink operation like Newsday (which, by the way, except for one headline story, has pretty much stayed away from the JE mess like Christie Brinkley from her snake of an ex). I like Christie, I'm glad she stood up to that jerk, but that's another blog.


And the Progressive defense about "we have other issues, and besides he denied it and we swallowed it"? McIlvaine minces few words:

And some of these progressive sites I go to, well, after a burst of righteous indignation, they seem to have fallen back to their sloppy ways of blaming everyone but JE and EE. He lied, he's still lying, everyone is lying...but let's not talk about it because, you know...we bought those lies. And since JE isn't going to be at the convention, hey, it's over with. Not important. Move along. We have to keep our eye on the prize.

Uh-uh. I'm not buying that shit.


Sounds like PJ might be liberal, but nobody's gonna tell her to get in (the party) line and shut up.

John Edwards Affair: Rielle Hunter's Family Wants Edwards Paternity Test

Edwards Casts Aspersions at More than the Enquirer during ABC Interview

John Edwards has now officially been put on notice.

The family of Rielle Hunter wants Edwards to put up or shut up.

After a televised interview with the ex-presidential candidate painted everyone, including his unnamed mistress Rielle Hunter as somehow sinister. Edwards, caught leaving the Beverly Hilton after a meeting with the Enquirer's reporters on July 22 also took shots at unnamed "supermarket tabloids."

The Enquirer published it's response to Edwards by labeling his interview a "confession". [JOHN EDWARDS ADMITS AFFAIR!]


As far as being the father of Hunter's love child, you might as well go all the way now, Johnny Boy.

Submit to a DNA test.


NOW, ABC News is reporting that the Mistress' Family Challenges Edwards to Take DNA Test.

Hunter's sister, Melissa, has been reported by ABC News in an Enquirer-type sub-headline as saying, "'Stop Bad-Mouthing My Sister'".

ABC also quoted Hunter's sister as saying, "Somebody must stand up and defend my sister," she said. "I wish that those involved would refrain from bad-mouthing my sister,"--not naming Edwards, in the same way he avoided naming Rielle Hunter in his ABC appearance.

"Ironically, now, its John Edwards who's the one making allegations," wrote one reader, "without offering any more proof than his word--and he's shown how much we can all trust that."


UPDATE #1: 1345 EDT Class Action against Edwards?

Ted Frank at Overlawyered wonders, "Where's a trial lawyer when you need one?" [Yes, I’m being facetious]:


Where’s the trial lawyer bringing a class action on behalf of all of the people who were defrauded when they gave money to John Edwards’s presidential campaign? It’s certainly a much more plausible claim of causation, reliance, and financial injury than the typical class action.


If Frank were the prosecutor in the court of public opinion, Edwards' interview would get 30 days in the electric chair.

"Alas, ABC didn’t ask the right follow-up questions, such as how Edwards thought meeting Hunter in a hotel room would help keep the story quiet."

Frank has other penetrating questions for Edwards. We'll let him present them.

Scott Beauchamp: TNR Finally Confesses
Left Blogosphere Silence Deafening



Franklin Foer's article finally admitting the problems over the Baghdad Diaries' Scott Beuchamp was a painful read.

TNR's behavior is perfectly understandable: after all, after their past journalistic mishaps, who'd want to yet admit to another?

I mean, come on: if TNR was a drunk and had this many relapses, they'd have signed up for Antabuse a long time ago.

THE really hilarious part of this whole sorry story is knee-jerk reaction of the usual suspects: the Fiercely-Independent, Principle-Driven Left Wing Blogosphere.

Ferocious fact-checkers to a man, they could be counted on to guard their reputation as those who check the facts and deliver the truth to their readers.

What "truth" did they deliver?

We now let you dip your toe into the left-wing pool of truth concerning TNR and Private Scott Beuchamp's Baghdad Diaries.

The rightwing blogosphere, with assistance from the usual MSM types like Howard Kurtz has spent the last week or two trying to discredit a soldier, Scott Beauchamp, who wrote a “Baghdad Diary” for The New Republic, which included various examples of casually callous behavior on the part of US soldiers (nothing on the scale of Abu Ghraib or other proven cases).

The Beauchamp case fits the general pattern pretty well. First, the wingers claimed that the Diary was a fabrication and that “Scott Thomas” was the creation of a writer who’d never been near Iraq. Then, when it became evident he was a real person, they rolled out the slime machine to discredit him. Then they engaged in amateur forensics to discredit particular items in his account (acres of screen space have been devoted to the question of whether the driver of a Bradley fighting vehicle can run over a dog).

Digby thought the behavior of anyone wanting to know if a story is true or false is--well, we'll let him explain.
After a tremendous amount of wingnut pressure on TNR to prove they hadn't been duped by an imposter, now that they know he does in fact exist, they are working their way into a complete frenzy going after this soldier as if he were al Qaeda and acting as though the hawkish New Republic has just endorsed Cindy Sheehan for president. It's like watching a bunch of piranhas attack some kids who accidentally fell into the water.

It certainly should not have have garnered this vicious right wing attack from everyone from Bill Kristol to the lowliest denizens of the right blogosphere. They want to destroy this soldier for describing things that have been described in war reporting since Homer so they can worship "the troops" without having to admit that the whole endeavor is a bloody, horrible mess that only briefly, and rarely, offers opportunity for heroic battlefield courage (which, of course, it sometimes does as well.)

The ever-hopeful John Cole, at Balloon Juice, starts with no facts, but proves it's not going prevent his leaping into the fray against the lunatics attacking SCB.
Let’s discuss Scott Beauchamp, who was widely regarded as not existing, but who now exists- much to the chagrin of the lunatic fringe of the right wing blogosphere.

I guess we know why he didn’t put his real name on it- it is FRENCH sounding! Of course he wants us to lose! The VICHY have infilitrated the ARMY!

Max Blumenthal looks at the “reliable” sources that the Weekly Standard used to try to besmirch Scott Beauchamp: Matt Sanchez and Throbert McGee.

And yet they still get a national platform.

DailyKOS didn't fail to disappoint: their usual M.O. is up next. What fun! No facts, no problems. When short of hard info, trot out some invective--the usual substitute for facts.
The RW bloggers went crazy, accusing TNR of making things up, and in their typical fashion "proving" that Scott Thomas was a fake. Scott Thomas turned out to be real, which led to the normal character assassination from the RW.

Firedoglake couldn't really add anything about verifying Beauchamp, but they get to say "hate speech" and "Republicans" in the same paragraph, so it wasn't a total loss.

The Left Trifecta is the previous two, plus "Hitler" in the same paragraph. It took them another couple paragraphs to work the Feurher into the mix. They do get partial credit for "frothing", though.
The nameless fellow(s?) and good friend of Michelle Malkin's behind the right-wing blog aggregator Volunteer Opinion Journal thinks he's caught us all being naughty. Pretty mild stuff, compared to what his comrades were and are saying about Scott Thomas Beauchamp (for more, go here and here), but hey, you work with the "hate speech" you have, not the hate speech you wish you had -- such as what regularly issues from the posts and comments over at Michelle Malkin's shop. These people are the Republican base, and as TRex points out, this is precisely why the Republicans don't dare do a YouTube debate in which their base has any sort of say: It would hand the presidential election to the Democrats the same way that Pat Buchanan's Republican-pleasing froth-at-the-mouth speech at the 1992 Republican National Convention guaranteed that Bill Clinton would be our next president.

Okay, we could go on like this for a long time, but we've got to move on, much as I'm sure the above stalwart Left Wing Warriors will do on this particular issue.

They were noticeably absent from comment on the affair yesterday.

Probably too busy with their next piece about Hitler-like Michelle Malkin frothing hate speech about Left Wingers.

Baby Grace, Riley Sawyers: Mother's Grim Tale of Abuse and Death

The grim details of the last days of little Riley "Baby Grace" Sawyers life have begun to emerge.

From today's Galveston County Daily News:
In an interview, Kimberly Dawn Trenor, 19, of Spring, told investigators that she and her husband, Royce Clyde Zeigler, 24, beat her daughter with two leather belts the morning of July 24, an affidavit says.

They also held her head underwater in the bathtub and Zeigler picked her up by her hair and threw her across the room, slamming her head into tile floor, the affidavit says.

An autopsy on Oct. 30 found that the child had three skull fractures on the back of her head.

The pair also smothered the girl by pushing her face into a pillow in her room and into the cushions of a couch, the affidavit says.

Trenor told investigators that, during the beating, her husband gave the girl child’s pain medication and covered her with a purple towel after she was dead, the affidavit says. [1]
Kimberly and Royce went to Walmart for the specific purpose of picking out a "suitable" container to dispose of little Riley's dead body. One can imagine the two walking the fluorescent lit aisles, looking at various sized plastic containers until choosing the "right" one.

They then wrapped her in plastic and placed her in a blue plastic tote. They put the tote out in a storage shed in the backyard of their Spring home. The authorities are not quite sure how long little Riley's body was kept there, anywhere from one to two months.



One could see Kimberly looking out the kitchen window to the storage shed where her daughter's body lay while she washed the dishes or cooked dinner. Of Royce mowing the lawn or waving to the neighbors, the children who played in the yards next door. Of Kimberly and Royce talking in quiet whispers, discussing where they could take Riley, where no one would ever find the evidence of what they had done.




The couple took the remains in their car and tossed them into the water near the Galveston Causeway, the affidavit says.

On Oct. 29, a fisherman found the plastic bin with the little girl inside.[1]
When the plastic storage tote containing Riley's body was found resting on a sand bar the Galveston County Sheriff's Department took over the investigation. They found her wrapped in plastic, she wore a little pink skirt and matching blouse, little tennis shoes that flashed bright lights from the heels. No one had reported a little girl missing. No one knew who this little girl in the plastic tote was. They released a composite sketch of Riley and dubbed her "Baby Grace." [2]


Did Kimberly and Royce see the newspaper and media reports about the unidentified "Baby Grace" case? Did they discuss the case with neighbors? Did they believe that dumping Riley's body into Galveston Bay would be the end, that somehow, they would be in the clear?

They both sit in Galveston County Jail. One wonders what possible defense their attorney's will present. Bets are, they'll soon point the finger of blame at each other.
