The Obama birth certificate issue may become an issue.

Phillip Berg may have had his case dismissed in a Philadelphia federal court for lack of standing, but cases filed in the last few weeks in eight state courts are still pending over Barack Obama's citizenship issues.

Berg says he plans on appealing to the U.S. Supreme Court.

Our opinion: the appeal will likely be denied, due to the standing issue.

Berg filed suit in court to force the Democrat nominee to produce an original "vault" copy of his birth certificate. Obama and the Democratic National Committee chose to fight the lawsuit, rather than produce the birth certificate.

Obama left the campaign trail for a few days last week to see his ailing grandmother in Hawaii. Rumors swelled over the timing of the visit. DBKP took the campaign's announcement at face value.

Yesterday, it was reported that the Hawaii Governor, Linda Lingle, has had the Obama birth certificate placed under seal.

HONOLULU, Hawaii – Although the legitimacy of Sen. Barack Obama's birth certificate has become a focus of intense speculation – and even several lawsuits – WND has learned that Hawaii's Gov. Linda Lingle has placed the candidate's birth certificate under seal and instructed the state's Department of Health to make sure no one in the press obtains access to the original document under any circumstances.

The governor's office officially declined a request made in writing by WND in Hawaii to obtain a copy of the hospital-generated original birth certificate of Barack Obama.


A source told World Net Daily "...confidentially the motivation for withholding the original birth certificate was political, although the source refused to disclose whether there was any information on the original birth certificate that would prove politically embarrassing to Obama."

Meanwhile, Kenyan authorities told WND that "all documents concerning Obama were under seal until after the U.S. presidential election on November 4."

Odd though the above situation may be, there's no need to invent rumors, as Jeff Schreiber notes.

From Addressing the Rumors Surrounding Surrick's Decision:

The newest thing, I see, is that the Hon. R. Barclay Surrick somehow was implored to decide as he did in the Berg v. Obama suit, that the memorandum and order was somehow thrust upon him by a former law clerk who now works closely with Michelle Obama. Fax transmissions shown on the readily-available document have been called into question, as though the judge was sent the decision he was supposed to render.


To which Schreiber replies, "People, come on."

We couldn't agree more.

There's enough questions surrounding this issue without manufacturing any: such as impugning the judge involved. Phillip Berg was always going to have the standing issue against him--whether you agreed with the thrust of his lawsuit or not.

The standing doctrine is crystal clear. The law, in this case, was on the side of Barack Obama and the DNC when it came down to the procedural details. To prevail, Berg needed Judge Surrick to play the role of judicial activist and expand the law as it stands today. I've noted before that the standing doctrine had changed over time, but just because the judge [unfortunately] declined to change it again, we cannot simply assume that he was somehow coerced to uphold the law.


The campaign may not have addressed this issue--just as it has not addressed the issue of not releasing Obama's medical, college and university records--by providing a copy of Obama's original birth certificate.

There may be some movement in the federal lawsuit, Berg v. Obama, today.

Jeff Schreiber, a legal student who's also been covering the case from Philadelphia and has sources inside the federal courthouse is writing that there likely could be a ruling before this weekend.

"I have, from good and reliable sources, information suggesting that the Hon. R. Barclay Surrick will come down with an order and memorandum either on Thursday or Friday."

This space is reserved for news on that order. Therefore, unless something monumental occurs over the next two days, I will not be reporting anything further so as to reserve this spot for news regarding the decision in the Berg v. Obama case. It should be easier for everyone that you can simply check this part of the page for news of the order without having to wade through anything else.



Schreiber, who was the first to write about the Berg suit (Berg is demanding that Barack Obama supply the court with proof of his U.S. citizenship), has been the best source of news on Berg v. Obama.

Schreiber's site, America's Right, has a complete archive of the motions filed by both sides in the lawsuit and a trip through AR's archives, located on the right sidebar, will get readers up to speed on the case from the beginning.

Schreiber's best guess (he clearly labels it as one) has been that Berg lacks standing to sue Obama in federal court. From talking to his sources, Schreiber senses that the judge may surprise everyone on this point.

Common sense, for the past two months, has told me that Philip Berg's case will be eventually dismissed on grounds of lack of standing. Nevertheless, I have had a gut feeling that Judge Surrick may very well just surprise us all -- the information I have been getting over the past 24-36 hours reinforces that gut feeling.

"Please refrain from calling the courthouse, as I am told that the phone calls are coming in at the rate of several dozen each day. And, as always, keep checking here at America's Right for updates, especially this crucial one. America's Right was the first to report on this lawsuit when it was filed on August 21, and I have no reason to believe that America's Right will not be the first to report on the judge's decision."

NOTES:

* DBKP has attempted to reach Phillip Berg over the last 24 hours, but Mr. Berg was out of his office yesterday, making the rounds of talk shows. Berg appeared on three different ones yesterday, including G.Gordon Liddy's.

* There have been two lawsuits in the states of Washington and Hawaii asking Obama to provide the secretary of state with basically the same information sought by Berg. According to reports, these cases would have a much better chance of success on the standing issue.


AFRICAN PRESS INTERNATIONAL





On the African Press International story (Michelle Obama's supposed phone conversation with a small African news agency), a much different update was being prepared than this one.

It has been nine days since African Press International claimed that Michelle Obama called one of its correspondents and made some controversial remarks. [Shocking development: Mrs Obama decides enough is enough: "My husband was born in Hawaii and adopted by his step father, does that make him unpatriotic; she asks", on a direct telephone to API.]

Some bloggers have grown impatient and washed their hands of the entire affair, pronouncing it a hoax.

These writers may very well be correct in their assessment.

Our opinion?

We really don't have one. We have no reason to disbelieve African Press International's account of the incident. The Obama campaign quickly issued denials to ABC and NRO concerning the story. That makes it a legitimate story in our minds, so we'll report on it.

DBKP was ready to join their ranks of those believing it was a hoax and decided to reserve judgment a bit.

Our reasoning?

We're here to report on the developments--if any--of this story. Is it a hoax? We repeatedly said: we don't know. We don't think anyone else at this point, outside of the principals involved, knows either. We'll let our readers make their own decisions about whether they believe or disbelieve the API stories.

That being said, DBKP has obtained information that legal representation for API for all of North America has been worked out and that the attorneys involved believe that they will have possession of the audio tapes later today.

From all accounts, API is described as a bunch of amateurs, unschooled in handling the unexpected attention their story brought them.

We've also received a few reports that several people have heard "snippets" from the tapes and that that they appear to be legitimate. We will caution:
  • We have no way of confirming this;
  • We have no way of knowing how these individuals arrived at their decision that they appeared legitimate; and,
  • We have no information on whether the individuals who've claimed they've heard the "snippets" of the audio have any particular background or expertise in validating or authenticating audio tapes.


We do have more reason to believe that whatever audio is available will be in the hands of attorneys in North America today.

The question of whether they are real or not would then have to be examined.

We will post more information as it becomes available and, as always, let our readers make their own judgments.

Why Has Obama not only released his citizenship records, but his college records?

American Thinker calls it "a game changer".

When we were talking to Phillip Berg on Wednesday, he mentioned that a film crew was coming up to show a video for YouTube and that he was meeting them at 4 pm.

Three days later and that video is out.

From "This could be the game changer":

A lifelong Democrat who has held political office and been a committeeman, Philip Berg, has brought suit over the real questions raised by the absence of a valid Obama birth certificate. His narrative of the various questions Obama has refused to answer is devastating. Graphics and sound are well-deployed to avoid tedium as factual data is conveyed in a way that allows viewers to absorb it. When he contrasts Obama's behavior when challenged (use perfectly valid legal technicalities to delay) with John McCain's full disclosure of all documentary evidence under a similar challenge (remember the flap over his birth in the Panama Canal Zone? -- who raised those questions, anyway?), there is no doubt in a viewer's mind that there is something seriously wrong here.

We are talking about the Presidency and this guy stonewalls?

The only way Obama can satisfactorily respond is to release his supposed Hawaiian birth certificate. If he has it, why hasn't he released it? If he does release it, game over. So why drag this out on technical grounds? It doesn't make sense.





The John Edwards Scandal

During John Edwards presidential run, after November, not one MSM reporter asked Edwards one single question about his relationship with Rielle Hunter. Even after the National Enquirer caught Edwards in the Beverly Hilton as he left Hunter's room at nearly 3 in the morning, the MSM silence was deafening.

It was not until Edwards confessed that the AP, CBS, Time, Newsweek, New York Times, CNN, ABC, MSNBC, NBC and the rest of Big Media felt they could inform their readers/viewers about the news.

Most of the MSM stories were of the "we didn't tell you, and now we are and here's why" variety. Within those stories were plenty of snide attacks at the few places that did pursue the Edwards story.

The MSM were not nearly in the tank for Edwards then as they are for Barack Obama now.

Obama's records have proved hard to come by and the Mainstream press doesn't investigate, doesn't ask questions, doesn't care.

Records that any American may be called upon to release to an employers--birth records, proof of citizenship, college records--remain hidden from public view just 25 days before the election and the media has not said a word.

We'll ask the same question we did during the Edwards' scandal:

If there's nothing to hide, then why are you hiding it?

Readers wishing to stay abreast of current happenings in the Obama birth certificate/citizenship case in US District Court for the Eastern District of Pennsylvania (Philadelphia) would be wise to bookmark Jeff Schreiber's America's Right site.

Schreiber's a legal writer/reporter during the day, but then changes into his blogger's costume at night: he's located near the court and brings a lot of things, not the least which is knowledge of the case, to the table. America's Right was the site which first reported the Berg v. Obama lawsuit in August.

It's also the site where we first discovered a report on the federal suit.

Schreiber's been all over this story from the beginning and it shows.

Schreiber's view seems a lot like our own. While he's conservative, he's also skeptical of some claims made in the Berg suit (perjury), but curious about the questions Berg raised.

The Obama birth certificate story is a lot like the John Edwards scandal: it's hard to get everything of interest in one post. An attempt was made yesterday to bring readers who had not heard about the case "up to speed".

In the wrap to yesterday's article here on the Federal Lawsuit in which Phillip Berg is asking Barack Obama to provide proof of U.S. citizenship, we left a few things out.

A couple of items we asked Mr. Berg in our phone conversation didn't make the article. Readers may be interested, so we'll include them here. They include the coverage Berg v. Obama has (not) received in the MSM, among other things.

MONDO: What has been the reaction of the Mainstream Media to this lawsuit? This sounds like a big story: a presidential candidate has balked at providing proof of citizenship. Have you been contacted by any MSM organizations?

PHILLIP BERG: There's been no reaction because they haven't covered it. There's been some interest, but nothing so far.

MONDO: What were your reasons for filing the lawsuit.

BERG: I filed the suit because I believe the Democratic National Committee hasn't performed its duties. I believe that the Republicans know about this and will bring it up right before the election. There may be time for the DNC to substitute someone on the ballot, but there may not be.

[The phrase "constitutional crisis" was discussed at this point.]

MONDO: You're alone on this. How could someone help you if they wished?

BERG: Get the word out on this. If enough people hear about it, it might create some pressure.

Did the GOP Uncover an Obama Birth Certificate in Kenya?



Some good research into several of the citizenship issues were found at What's Your Evidence. The site's only agenda, upon first inspection, appears to be fact checking.

They discount the Indonesian citizenship issue, leave open the place of birth issue and leave open the citizenship issue in its totality.

From What's Your Evidence?, "Was Obama Born in Kenya? Is Obama a Kenyan Citizen?"

"[Madsen reported that the GOP] ... located a Certificate Registering the birth of Barack Obama, Jr. at a Maternity Hospital, to his father, a Kenyan Citizen and his mother, a U.S. Citizen. "

GOP dirty tricks operatives dispatched to Kenya .... believe they have found a "smoking gun." In this case, it is a birth certificate from the Kenyan city of Mombasa registering the birth of Barack Obama, Jr., on August 4, 1961.

However, the registration is a common practice in African countries whose citizens abroad have families with foreign nationals. Obama was born in Honolulu, Hawaii, to his Ann Dunham of Wichita, Kansas, and Barack Obama, Sr., of Nyangoma-Kogelo, Kenya.

NOTES: We have not yet found evidence to support or refute Madsen's contention that such registration is a common practice.




"[Did the GOP, in fact, locate a Certificate Registering the birth of Barack Obama, Jr. at a Maternity Hospital, to his father, a Kenyan Citizen and his mother, a U.S. Citizen?]"

Although we can find no evidence that the GOP located a Kenya "certificate registering the birth" of Obama (other than Madsen's unsourced assertion), political parties may elect to withhold information until a time they deem politically expedient. Thus, it is possible that the GOP located such information and just has note yet released it. Thus, we do not know whether this statement is true or not.

(I know - his parents must have forseen that they would need to fake his natural born citizenship when he was born, in case he wanted to run for President.)

Really, you know when Ronald Reagan was running for President, conservatives appealed to American voters by talking about ideas - free enterprise, limited government, civil liberties. That was the high road, and it worked. It’s sad to see what the movement has become 28 years later. No wonder real conservatives like Charles Krauthammer and George Will are so despondent about what’s happened to formerly intellectual conservatism."

Gregg's comment above would describe our present position exactly. We don't know if this is true and clearly said so.

BUT, politicians exhibiting "curious behaviors" interest us. For some reason, we want to ask questions.]

In the John Edwards scandal, the National Enquirer's initial story on the affair passed without comment at DBKP because it contained very few facts that could be checked. That changed after the December Enquirer story: there were plenty of facts and the Edwards' campaign and the principals involved exhibited curious behavior for a group of people surrounding a presidential candidate--if they had nothing to hide.

Likewise, the issue of the Obama birth certificate did not excite our interest initially. The curious FactCheck.org language and the the debunking of several of their "facts" caught our interest. Also, FactCheck's post comes across as extremely biased in our closer reading. Why hurl invective at people who ask a fact check site to check facts? Why post that digital images have not been altered when it quickly established that they had? That was interesting.

Finally, the Obama campaign's curious behavior in reaction to Berg v. Obama was the kicker. This "silly suit" could have been dispatched PDQ by ponying up the documents requested. The Berg suit says as much. That the campaign, rather than just produce the vault copy birth certificate has decided to devote legal resources to fighting it just doesn't make sense. They could put this issue to bed with on FEDEX delivery.

That they chose not to led to our article.

It does not help that Obama:
  • has been less than forthcoming about his past associations;
  • Changed his story as more facts become available on several of these questions, particularly Jeremiah Wright. Initially, Obama vigorously defended Wright before claiming that he "didn't hear him say those things" while sitting in his church for 20 years. This is also clearly the case the more Obama talks about his years-long relationship with William Ayers;
  • has refused to make many documents available which might help his case--or hurt him badly. IN particular, his thesis from college falls into this category. The problems Stanley Kurtz had in obtaining the Chicago Anneberg Challenge records also comes to mind.

Student Files Federal Lawsuit: Alleges Teacher Christian Basher


A sixteen-year-old student and his parents have filed a federal lawsuit against the boy's Advanced Placement European History teacher at San Juan Capistrano High School.

James Corbett, who teaches Advanced Placement European history at Capistrano Valley High School, consistently "demonstrates a sense of hostility toward religion," causing Christian students to "feel ostracized and treated as second-class citizens," according to the lawsuit filed in federal district court in Santa Ana by Chad Farnan, 16, and his parents, Bill and Teresa.

The lawsuit contends, among other things, that Corbett told students during class that "when you put on your Jesus glasses, you can't see the truth"; said that religion is not "connected with morality"; compared Christians to "Muslim fundamentalists" who want women to "stay pregnant, barefoot, and in the kitchen and have babies until your body collapses"; and suggested that churchgoers are more likely to commit rape and murder.
Principal Tom Ressler defended Corbett as a "solid" and "popular" teacher, that these were merely "allegations" against the teacher.
The student took a tape recorder to class and left it on his desk in plain sight.
"I'm not sure whether he saw me," the student said. "He's against Christianity and bashes it all the time. He's been indoctrinating us and not teaching the class; we don't need to be hearing his political views during school time when we should be learning."
At issue is whether the alleged "hostility" shown by the teacher towards religion construes a type of "indoctrination." Whether the teacher is a representative of the state and therefore should remain neutral.

The student and his parents do have a point. Students are held "hostage" by teachers who use their class as a bully pulpit, who in essence, become "preachers" instead of teachers. The students cannot speak out for fear of a lesser grade. The teacher, in his role as an authority figure, is using his classroom to bash Christians.

Public schools are funded and paid for by quite a few Christian tax payers. If teachers feel the need to "preach" instead of teach that's fine. Just not on the public dime.
