Is something big about to break in the Obama birth certificate story?

The questions surrounding the constitutional eligibility of Barack Obama to serve as U.S. president continue. After abating a bit immediately prior and after the election two weeks ago, more information has surfaced which has returned the issue to the blogosphere.

The Mainstream Media not only blacked out the issue after June 2008, they actually contributed to the Obama's campaign effort to cast anyone with questions about Obama and the many missing pieces of his past as "smear merchants" and "rumor-mongers".

Three items, in particular, have caught our attention:

World Net Daily has really ramped up their coverage of the Obama birth certificate issue today. WND's front page contains almost nothing else but stories on the matter. Such as:

* Proofin' the prez: Who's in charge? Constitutional lawyer says electors have duty to investigate citizenship
* Obama's birthplace heats up Liddy show
* Is he or isn't he? The debate over Obama's eligibility

World Net Daily is the home to Dr. Jerome Corsi, author of Obama Nation, and a visitor to Kenya who was ejected from the country quickly upon arriving weeks ago.

Does World Net Daily have something that it is about to break on this story?

We don't know. But we notice things.
The Kenyan Ambassador.

Earlier today we provided a link to a video of the Kenyan ambassador stating that Barack Obama's birthplace in Kenya is already getting plenty of visitors since he became president. [MORNING INTELL: Kenya, Iran, Israel, PC Nazis, Natalie Holloway]

This slip--or not--of the tongue, combined with Justice Clarence Thomas' conference scheduled for December 5 on Denofrio v. Wells, has added fuel to the Obama citizenship fire. [Obama Birth Certificate, Citizenship: SCOTUS Conference Scheduled for Dec 5]

Today, WND published another article claiming to debunk the Certificate of Live Birth which the Obama campaign featured on its fightthesmears.com site. [Rathergate II: Certification of Live Birth a clear forgery] From the WND piece by Janet Porter:

It's Rathergate all over again with more amiss than a 1970s Selectric typewriter. But before I tell you what the experts found, let me ask you a few questions:

1. If you were a natural born American citizen and had it within your means to quiet all the lawsuits and questions with proof, would you do it?

2. If you were a natural born American citizen, would you spend thousands of dollars to fight the legal cases against you, or would you simply answer the legitimate question of whether you meet the constitutional requirements for office?

3. If you were a natural born American citizen, would you forge a document called a "Certification of Live Birth" and tell the public it was a real "birth certificate"?

If someone were to violate the law by manufacturing a forgery in order trick the public, would that be enough evidence for members of Congress to conduct hearings and for a court to issue an order for the critical records, including the original long-form birth certificate (signed by the doctor) to ensure that the U.S. constitutional requirements for office were not violated? After all, Congress is sworn to uphold and defend that Constitution, and the justices on the U.S. Supreme Court are "guardians" of the Constitution. That's their job, isn't it?

These are much the same questions that others, as well as DBKP, have been asking. In fact, in Obama Birth Certificate Federal Lawsuit: The Curious Behavior of the Obama Campaign, we observed:
Quiz time for DBKP readers.

Let's say you're a Democrat and let's say you're running for president of the United States.

You're a likable guy and are doing well--the New York Times and AP think you're peachy--but there have been whispers of whether or not you are constitutionally qualified.

A prominent Democrat files suit in Federal court asking you to provide proof, to settle the matter once and for all.

What do you do?
- A. Provide the court with the three documents in question and go back to shaking hands, making promises and smiling for the cameras.
- B. Provide images of one of the documents to a friendly website to post, but not to the court.
- C. Ignore the request, then make a motion to dismiss the case, in lieu of providing the proof.
- D. In the meantime, quietly, post a notice at your website, FighttheSmears.com that you had dual citizenship with Kenya.
- E. Hire the top gun attorney from the Council of American-Islamic Relations (CAIR) to fight the case.
- F. File a Joint Motion for Protective Order to Stay Discovery Pending a Decision on the Motion to Dismiss (which was) filed on 09/24/08, thereby putting the matter off until--hopefully--after the election.
Time's up. What do you do?

Most readers sensibly chose A.

But, if you're Barack Obama, you chose answers B, C, D, E and F.

A curious response for a campaign interested in "fighting the smears".
Suffice it to say: not everyone bought into the Certificate of Live Birth explanation by the campaign. But more proof was needed because Obama wasn't allowing anyone to see his original "vault" copy of his birth certificate for some unknown reason.
African Press International is preparing for, what they claim will be the airing of the Michelle Obama phone conversation that they claimed they had with her on October 15.

API claims that Ms. Obama raises citizenship issues with the African Press International correspondent on the phone call. The release and airing of the audio tape of that phone call is reported to be imminent.

We could write much about the API situation, but will hold off a while longer.

But perhaps, not too much longer.

We've given our reasons for holding out the belief that African Press International's version of the Michelle Obama phone call was true. The reasons are outlined in several of the links below.

So what's the scoop? Why all of the attention all of a sudden on the Obama birth certificate--especially from World Net Daily, which has had the resources to pursue the story.

WND also has had something going for it in this story that the MSM didn't: the desire to to uncover the truth.

Is something big going to break in this story in the next 24-48 hours?

We do not know for sure. But we do notice things.

We have continued--even after African Press International didn't air their tapes previously--to follow and monitor the story. We still have many nagging doubts over an issue that could be settled quite quickly and easily: the release of the original Obama birth certificate.

But it hasn't been.

Like World Net Daily, we've remained suspicious and quietly pursued whatever leads we had. Many were dead ends. Some remain promising.

We try to verify everything we report. When something is a rumor, we report it. When we have access to information that we can't publish, but feel we're on the right trail, we'll report it to the best of our ability.

If we report something and the source turns out to be a false one, we'll report that also.

We respect our readers' ability to make judgments for themselves. Some will agree, some will disagree.

That's called a discussion and it's healthy.

It's also something not often found in the MSM.

Is something big going to break in the Obama birth certificate story in the next 24-48 hours?

We do not know for sure.

But we do notice things.

The Obama birth certificate issue may become an issue.

Phillip Berg may have had his case dismissed in a Philadelphia federal court for lack of standing, but cases filed in the last few weeks in eight state courts are still pending over Barack Obama's citizenship issues.

Berg says he plans on appealing to the U.S. Supreme Court.

Our opinion: the appeal will likely be denied, due to the standing issue.

Berg filed suit in court to force the Democrat nominee to produce an original "vault" copy of his birth certificate. Obama and the Democratic National Committee chose to fight the lawsuit, rather than produce the birth certificate.

Obama left the campaign trail for a few days last week to see his ailing grandmother in Hawaii. Rumors swelled over the timing of the visit. DBKP took the campaign's announcement at face value.

Yesterday, it was reported that the Hawaii Governor, Linda Lingle, has had the Obama birth certificate placed under seal.

HONOLULU, Hawaii – Although the legitimacy of Sen. Barack Obama's birth certificate has become a focus of intense speculation – and even several lawsuits – WND has learned that Hawaii's Gov. Linda Lingle has placed the candidate's birth certificate under seal and instructed the state's Department of Health to make sure no one in the press obtains access to the original document under any circumstances.

The governor's office officially declined a request made in writing by WND in Hawaii to obtain a copy of the hospital-generated original birth certificate of Barack Obama.

A source told World Net Daily "...confidentially the motivation for withholding the original birth certificate was political, although the source refused to disclose whether there was any information on the original birth certificate that would prove politically embarrassing to Obama."

Meanwhile, Kenyan authorities told WND that "all documents concerning Obama were under seal until after the U.S. presidential election on November 4."

Odd though the above situation may be, there's no need to invent rumors, as Jeff Schreiber notes.

From Addressing the Rumors Surrounding Surrick's Decision:

The newest thing, I see, is that the Hon. R. Barclay Surrick somehow was implored to decide as he did in the Berg v. Obama suit, that the memorandum and order was somehow thrust upon him by a former law clerk who now works closely with Michelle Obama. Fax transmissions shown on the readily-available document have been called into question, as though the judge was sent the decision he was supposed to render.

To which Schreiber replies, "People, come on."

We couldn't agree more.

There's enough questions surrounding this issue without manufacturing any: such as impugning the judge involved. Phillip Berg was always going to have the standing issue against him--whether you agreed with the thrust of his lawsuit or not.

The standing doctrine is crystal clear. The law, in this case, was on the side of Barack Obama and the DNC when it came down to the procedural details. To prevail, Berg needed Judge Surrick to play the role of judicial activist and expand the law as it stands today. I've noted before that the standing doctrine had changed over time, but just because the judge [unfortunately] declined to change it again, we cannot simply assume that he was somehow coerced to uphold the law.

The campaign may not have addressed this issue--just as it has not addressed the issue of not releasing Obama's medical, college and university records--by providing a copy of Obama's original birth certificate.

Obama's Birth Certificate and the Campaign's Response

For weeks, Internet blogs have been abuzz with questions regarding the validity of Obama's U.S. citizenship. Only recently have these questions been given serious consideration

Philip Berg, lifelong Democrat and Philadelphia lawyer, filed a lawsuit August 8, 2008, challenging Obama's claim of U.S. citizenship. The lawsuit could be resolved if Obama simply produces his birth certificate, which he has yet to do.

Questions have arisen about the birth certificate Obama initially placed on his web site. Well known Fact Check.org, attested to its authenticity but, as this video produced by Philip Berg shows, serious questions remain. Berg has pointed out that FactCheck.org is associated with the Annenberg Foundation, upon whose board Obama once sat.

Obama's grandmother has allegedly claimed to have been present at Obama's birth - in a hospital in Kenya. (Obama has taken the unprecedented step of suspending his campaign two weeks before the election in order to visit with his grandmother in Hawaii.) Obama's half-sister claims differently.

To date, the questions swirling around Obama's birth certificate have not been investigated or aired by any major media outlet. WPTV of West Palm Beach Florida is the only credible source to address this issue. They report, "The Obama camp and Democratic National Committee responded to the lawsuit by filing a motion to dismiss, but they never responded to the request for admissions."

Newsbusters.org, yesterday also reported on these allegations, as did conservative talk show host, Michael Savage.

RightBias.com considers William Berg's video compelling enough to be seriously considered. Though we have not done an in-depth investigation, the fact that Obama has yet to produce his birth certificate raises valid questions.

This video is app. 9 minutes long. Every American should have access to the information it contains in order to decide for themselves the veracity of Berg's allegations.

State Courts See More Lawsuits over Obama Citizenship Issue

Got this from Yid with Lid, NRO Cover's Obama's Birth Certificate-Lawsuits Spread to EIGHT States, who did yeoman's work in rounding up the lawsuits which have mushroomed over the last several days concerning the birth Certificate of Barack Obama.

Good Day for those looking to find out the truth about Senator Obama's Birth Certificate. Its finally growing beyond the "blogisphere." Andy McCarthy of NRO Picked it up today and the number of Law Suits is up to eight States. Senator, if all IS kosher with your "Certificate of Live Birth" then why don't you tell Hawaii to release your Official Document?:

While not found of court actions in general, all of this could have been avoided.

With the Obama website, "Fight the Smears.com" posting that Obama had dual citizenship with Kenya, questions were bound to arise.--questions which the campaign has sucessfully ignored thus far since posting the dual citizenship annnouncement.

Since the story is spreading rapidly over the last several days--Rush Limbaugh mentioned it yesterday, Michael Savage interviewed Phillip Berg last night and now NRO reporting on it--expect a curt denial from the campaign.

As well as the appropriate pieces in Big Media castigating any who have asked questions.

BERG v. OBAMA Federal Lawsuit

Jeff Schreiber at America's Right--who broke the Berg v. Obama lawsuit story on the Internet and has excellent coverage of the lawsuit has news. From Space Reserved for News on Court Order

Second, I was told yesterday afternoon that the order would likely be coming down either late yesterday--5:30 to 6:00 p.m.--or some time this morning. Obviously, Judge Surrick has the final word on this, and if he feels that he is not satisfied with his memorandum, especially considering the number of new filings this week, it may be later.

Schreiber also reports what may be a rightly called a bombshell:

Incidentally, Philip Berg was on Michael Savage's radio program last night and spoke about taped evidence, and sworn affidavits, that he has showing Obama's paternal grandmother in Kenya saying that she was present in the delivery room for his birth. I know for a fact that Berg does indeed have tapes of this kind in his possession -- but as the parts I heard were in a language I did not understand [and he was in the process of having translated], I cannot attest for sure that the tapes contain what Berg contends.

This is complete news to many--including DBKP.

AFRICAN PRESS INTERNATIONAL and MiCHELLE OBAMA tapes

There are so many conflicting stories on the African Press International story that we will refrain from comment until some hard info can be obtained.

DBKP has received emails with many claims. Some of these claims are very believable and come from sources that are credible. Some are not.

The only thing we know for sure is that World Net Daily is reporting that it has an unnamed source at Fox News that is saying that there are no negotiations with Fox News ongoing over the API tapes.

Fox News denies negotiating over 'Michelle Obama tapes':

"A Fox News official who requested anonymity said there simply were no negotiations with API over any tapes or any other issue."

The number of rumors and speculation over Barack Obama seems to have hit a hit point in the last few days. Rumors over such things as Obama's relationship with Frank Marshall Davis, parentage, and other issues has grown.

We don't put any stock in many of the rumors; but when information is kept from the public, the public will many times supply its own information. The secrecy surrounding the Obama medical, college and university records only fuels the speculation.

We will only remark: a wait and see attitude seems advisable--heavy on the "wait".

Obama's Cousin Raila Odinga; Violence Against Christians Broke Out After Loss

Obama's efforts to influence the election in Kenya has been relatively under-reported by the media in America. Specifically, Obama has lent his good name and fortune to the candidacy of Raila Odinga.

On one level this support is not surprising, as Obama made clear in his Dreams From My Father that he considered himself some sort of quasi-citizen of Africa--especially Kenya, his ancestral home.

And it should be noted that while Obama never really knew his father, he does know Odinga. And Odinga claims, rather credibly--but without written proof--that he is a relative of Obama. Both are from the Luo tribe of Kenya.

"Kenyan opposition leader Raila Odinga has said he is a cousin of US presidential hopeful Barack Obama.

Mr Odinga told the BBC's The World Today that Senator Obama's father was his maternal uncle."

Obama apparently denies the relationship. But that has not prevented him from supporting Raila Odinga.

Obama has contributed about $950,000 to the Odinga campaign.

These monies were reported to have come from "The Friends Of Senator BO:

World Net Daily reports: "According to several highly credible ex-ODM sources WND interviewed in Kenya, the $950,000 raised for Odinga's campaign came from a series of private meetings arranged for Odinga by Mark Lippert, a foreign policy adviser in Obama's U.S. Senate office. The meetings with top-dollar Obama fundraisers and donors took place during Odinga's 2006 trip to the U.S."

Obama was by no means the only recognizable figure on the list.

Dick Morris is there. So is Omar Khaddafi.

And although the list of donors on the internal document--purportedly issued as a memorandum by Orange Democratic Movement, Odinga's party--appears true, it has some oddities. Like, who is Spectre International and Associates?

Nevertheless the document is generally thought to be true, and it does follow a series of leaks of internal Orange Documents by certain former staffers.

So who is Odinga?

Well, that is troubling. Because this is a very unpleasant man.

He was jailed in 1982 in a failed coup. Although he is said not to be a Muslim he was initially set up in the Kenyan oil business by Khadaffi; he parlayed that into a lot of influence and money.

The Saudis were particularly helpful in advancing his "career". He also developed a lot of ties with the radical Muslim community, an alliance--allegedly brokered by the Saudis--that he hid from his own political party and its members. And for good reason: Odinga's election goal appears to have been to effectuate a Muslim coup of the government, although Muslims make up only 10% of this Christian nation.

According to Voice of America and the Evangelical Alliance of Kenya, on 8/29/07, Odinga signed a secret agreement (exposed 11/27) with Sheikh Abdullah Abdi of the National Muslim Leaders Forum (NAMLEF) in which he agreed to institute Islamic law in exchange for Abdi’s support (eakenya.org)–thereby potentially disenfranchising and curtailing the liberties of millions of Christian Kenyan women. Further, he promised that Muslims suspected of terrorism would be safe from extradition—thereby establishing a ‘safe haven’ for terrorists in Kenya.

After the public outcry, Odinga denied signing a secret agreement. Angry at Odinga’s apparent repudiation, a member of NAMLEF subsequently released the agreement to the press. Odinga then claimed the document was a forgery, but acknowledged a secret agreement had been signed in exchange for Muslim support. Finally, under constant pressure, Odinga released what he claimed was the actual document (“Real” MOU) a considerably watered down version of the original; but still anathema to many Christian groups. “In response to the revelations, The Evangelical Alliance of Kenya released a statement in which church leaders said Raila, in both MOUs, ‘comes across as a presumptive Muslim president bent on forcing Islamic law, religion and culture down the throats of the Kenyan people in total disregard of the Constitutionally guaranteed rights of freedom of worship and equal protection of the law’” (“Concerns Raised Over Alleged Vow To Enforce Islamic Law in Kenya” Christian Post 12/18/2007) To many westerners, the idea of imposing Sharia in a predominantly Christian country may have seemed fanciful. However, Kenya has had Sharia courts for family law (not criminal law)—called Khadi courts—since 1963.

Many liberals here in America doubt this memo exists--despite Odinga's initial lies and subsequent admission. But, the liberal analysis seems weak and strained. They argue that it would violate the Constitution. A rather stupid argument when the Memo itself calls for the repudiation of the Constitution. I mean, it is not like Odinga ever gave a rat's ass about legalisms in the past. For instance the document (https://secure.wikileaks.org/leak/MOU_between_Ralia_Odinga_and_Muslims.pdf) provides:

b) Within 6 months re-write the Constitution of Kenya to recognize Shariah as the only true law sanctioned by the Holy Quran for Muslim declared regions.

c) With immediate effect dismiss the Commissioner of Police who has allowed himself to be used by heathens and Zionists to oppress the Kenyan Muslim community.
g) Within one year facilitate the establishment of a Shariah court in every Kenyan divisional headquarters.

But Odinga lost the election.

Initially it was credibly reported that Odinga lost by fraud perpetrated by the incumbent, a not particularly strong candidate because of his promise not to run again. (Has a candidate ever kept that promise?).

But then the government persisted in its allegation that Christians had been disenfranchised from certain voting districts. And while we will likely never know who was the winner of the election, we know who the losers were: Kenya, free speech, Christians and members of tribes other than the Luo and their allies.

As Market Watch reported:

For a few days both Nairobi and Kisumu were literally ablaze. Candidates who escaped the violence and who chose to run on parties other than the party Oginga was running on had to publicly step down when Oginga attended their rallies and publicly asked them to step down and support his party.

But that hardly touched upon the horror unleashed upon anyone identified as Christian.

In an aftermath government report, it was learned that many Odinga supporters had stocked up on machetes, gasoline, and other weapons commencing months before the election. They did not hesitate to use them.

While some surmise that the Muslim/Luo riots were a response to election tampering, the stockpiling of weapons supports the supposition that the attacks were planned all along, even if Odinga won. It was to be a Muslim assault on Kenyan society, with large elements of tribal infighting.

Allies of convenience.

Under any circumstances the rioters had all of the characteristics of Muslim expansionists that the world has seen so often in the past 30 years. Christians were pulled out of their cars and killed if they were of the wrong religion. Their homes and businesses were burned. Young girls were gang-raped in front of their parents and siblings. Men were 'circumcised' with machetes while captive crowds were forced to watch. Limbs were hacked off, both men and women were sexually mutilated in the streets and left to die.

It is estimated 1,500 died. The result was the exodus of 150,000 people from their homes. An attempt to purify Muslim/Luo areas and establish control.

The Mainstream Media still pretends this had nothing to do with religion.

Odinga is a pig.

As for Obama, we found an excellent summary by Zimbio on Free Republic.

It would be difficult to improve upon.

Clearly, Obama campaigned for someone who is corrupt, ruthless and has financial ties to terrorists.

More importantly, Obama campaigned for a candidate who had the stated objective of dismantling US & Kenyan government efforts to root out Al Queda and other terrorist organizations--organizations that had already caused the deaths of hundreds of Americans and Africans in embassy bombings.

Senator Obama’s actions—intentional or not—were in direct conflict with the efforts and interests of US national security.

I think this raises serious questions about the judgment, maturity and readiness of Senator Obama.

Barack Obama has an Odinga problem, and it could be his Achille's heel, proving that Obama's only foreign policy achievement to date resulted in massive Muslim-led ethnic cleansing that murdered hundreds of Christians in Western Kenya in the post-election violence of his cousin Raila Odinga's failed 2007 bid for the Kenyan presidency.

Raila Odinga is the current Prime Minister of Kenya, and Barack Obama's first cousin.
Odinga's mother was the sister of Barak Obama, Sr, who was also a member of Odinga's Luo (or Jalou) tribe.

Odinga's father was the late Kenyan politician Jaramogi Odinga Oginga, and he, Barak Obama Sr, and Raila Odinga both attended the same Maseno high school in Western Kenya.

Kenyan Government: Obama an "Odinga Stooge"

Barack Obama campaigned extensively for Odinga in late 2006 while visiting Kenya on US taxpayer funded trips, and was even denounced by the sitting government as an "Odinga stooge".

Odinga was never elected Prime Minister, rather he ran as a member of the Orange Democratic Movement (ODM), and lost a close election to the incumbent President Mwai Kibaki by 250,000 votes.

This loss and the Odinga campaigns subsequent accusations of election fraud sparked horrible violence and ethnic cleansing between Odinga's Muslim Luo Tribe (13% of the Kenyan population) and Kibaki's Kikuyu (20 percent of Kenya's population) tribe, who vowed that without Odinga's election, there would be no peace, or "No Raila, No Peace".

The violence culminated in early January, when less than 24 hours after President Kibaki was sworn in, more than 50 Christians were burned alive in the Kenya Assemblies of God Pentecostal church in the western Kenyan town of Eldoret by orange clad ODM (Odinga) mobs, who attempted to shoot any who fled the burning church with arrows.

These pro-Odinga ODM forces referred to themselves as the Taliban, according to many sources, including John Kerry aide Alexandra Polier.

By the end of January, the disputed election directly caused the deaths of more than 1,500 people and the displacement of almost 600,000 more.

In an effort to quell the violence, an agreement was negotiated by Former UN Secretary General Kofi Annon in February 2008 where Kibaki would remain president and Odinga would be awarded the office of Prime Minister, only the second Kenya had ever had, and their cabinet would be staffed equally by both Odinga and Kibaki supporters.

After his appointment as prime minister, the press revealed a contract signed in August 2007 between Odinga and National Muslim Leaders Forum agreeing to several shocking concessions to Islam:

"Mr. Odinga had the backing of Kenya's Muslim community heading into the election. For months he denied any ties to Muslim leaders, but fell silent when Sheik Abdullahi Abdi, chairman of the National Muslim Leaders Forum, appeared on Kenya television displaying a memorandum of understanding signed on Aug. 29, 2007, by Mr. Odinga and the Muslim leader….The details of the MOU were shocking. In return for Muslim backing, Mr. Odinga promised to impose a number of measures favored by Muslims if he were elected president. Among these were recognition of "Islam as the only true religion," Islamic leaders would have an "oversight role to monitor activities of ALL other religions [emphasis in original]," installation of Shariah courts in every jurisdiction, a ban on Christian preaching, replacement of the police commissioner who "allowed himself to be used by heathens and Zionists," adoption of a women's dress code, and bans on alcohol and pork.

It was recently revealed by the head of Odinga's campaign finance accounting section, Shakeel Shabbir that, that Raila Odinga and his Orange Democratic Movement had accepted almost a million US dollars (66 million Kenyan shillings) from a bundler who was also Barack Obama's foreign policy advisor, Mark Lippert, and the "Friends of Barack Obama" political action committee, registered in Illinois from 1995-2005.

Shabbirthat also revealed a shocking series of emails that purported Barack Obama was may have directly advised Odinga during the Muslim on Christian post-election violence in Kenya.

Barack Obama's participation in his cousin Raila Odinga's campaign has been widely reported in the European press, but uniformly ignored domestically, perhaps because Barack Obama is not just vulnerable on foreign policy, it is his Achille's heel.

His greatest foreign policy achievement to date resulted in the Muslim-led ethnic cleansing and massacre of hundreds of Christians.

Quiz time for DBKP readers.

Let's say you're a Democrat and let's say you're running for president of the United States.

You're a likable guy and are doing well--the New York Times and AP think you're peachy--but there have been whispers of whether or not you are constitutionally qualified.

A prominent Democrat files suit in Federal court asking you to provide proof, to settle the matter once and for all. The judge then orders you to provide the court with the documents.

What do you do?

A. Provide the court with the three documents in question and go back to shaking hands, making promises and smiling for the cameras.
B. Provide images of one of the documents to a friendly website to post, but not to the judge.
C. Ignore the judge, then make a motion to dismiss the case, in lieu of providing the proof.
D. In the meantime, quietly, post a notice at your website, FighttheSmears.com that you had dual citizenship with Kenya.
E. Hire the top gun attorney from the Council of American-Islamic Relations (CAIR) to fight the case.
F. File a Joint Motion for Protective Order to Stay Discovery Pending a Decision on the Motion to Dismiss (which was) filed on 09/24/08, thereby putting the matter off until--hopefully--after the election.

Time's up. What do you do? Most readers sensibly chose A.

But, if you're Barack Obama, you chose answers B, C, D, E and F.

A curious response for a campaign interested in "fighting the smears".

What's the big deal? Regular folks provide their birth certificates every day for any number of reasons: obtaining a driver's license or marriage license come to mind. Heck, even kids have to provide a certified copy of their birth certificates to register for kindergarten in many locales.

Most people do it--if they're able--without much grumbling.

And they're not even running for President.

As DBKP kept asking for ten long months during the John Edwards' scandal:

"If there is nothing to hide, why is everyone involved going to such lengths to hide it?"

The Lawsuit of Phillip J. Berg

On August 22, we reported that attorney Phillip Berg had filed a suit in Federal court. [Denver Dem Convention: Clinton Supporter Files to Disqualify Obama]

The suit was against Barack Obama and the Democrat National Committee. It asked the court to force Obama to prove he was an American citizen.

Seems reasonable.

Do what thousands of Americans each day do--especially after 9-11: provide a birth certificate or proof of U.S. citizenship. It's a minor inconvenience, but they do it.

Saw this at Atlas Shrugged (via Memeorandum):

A prominent Philadelphia attorney and Hillary Clinton supporter filed suit this afternoon in the U.S. District Court for the Eastern District of Pennsylvania against Illinois Sen. Barack Obama and the Democratic National Committee. The action seeks an injunction preventing the senator from continuing his candidacy and a court order enjoining the DNC from nominating him next week, all on grounds that Sen. Obama is constitutionally ineligible to run for and hold the office of President of the United States.

Phillip Berg, the filing attorney, is a former gubernatorial and senatorial candidate, former chair of the Democratic Party in Montgomery (PA) County, former member of the Democratic State Committee, and former Deputy Attorney General of Pennsylvania. According to Berg, he filed the suit--just days before the DNC is to hold its nominating convention in Denver--for the health of the Democratic Party.

"I filed this action at this time," Berg stated, "to avoid the obvious problems that will occur when the Republican Party raises these issues after Obama is nominated.".

The suit asked for three documents:

1. a certified copy of Obama’s “vault” (original long version) Birth Certificate;
2. a certified copy of Obama’s Certificate of Citizenship; and
3. a certified copy of the Oath of Allegiance taken by Obama taken at the age of majority.

To date, attorneys for Barack Obama have filed almost as many motions fighting the lawsuit(2), as the number of documents the suit is asking for(3).

Again, that seems like curious behavior for a candidate anxious to dispel rumors about his qualifications and citizenship.

Why would that be?

We asked Phillip Berg.

"It's my belief that he [Barack Obama] can't produce the documents.

"If Obama cannot produce a certificate of citizenship, that would make him an illegal alien. In that case, he should be arrested, tried and deported."

Senator Obama could put this whole thing to rest by providing an official "vault copy" birth certificate. The fact that he's fighting it shows me that he can't produce the documents."

Again, that sounds reasonable to us.

On September 24, the day before Obama posted his dual citizenship admission on FighttheSmears.com, his legal team filed (with the DNC's lawyers) a Joint Motion for Protective Order to Stay Discovery Pending a Decision on the Motion to Dismiss.

Berg's been quoted as saying that this action "outraged" him.

"[T]his is another attempt to hide the truth from the public; it is obvious that documents do not exist to prove that Obama is qualified to be President.”

Their joint motion indicates a concerted effort to avoid the truth by attempting to delay the judicial process, although legal, by not resolving the issue presented: that is, whether Barack Obama meets the qualifications to be President.

We asked Berg: Why would Obama do this? Why not just produce the documents? Why delay discovery--effectively ensuring that the documents will not have to be produced until after the election?

"I can only assume that if Obama wins, they will then claim that you cannot sue a sitting president."

Oh.

Dual Citizenship?

Two weeks ago, the Obama campaign did another curious thing.

On September 25, at Obama's FighttheSmears.com, the campaign admitted that Barack Obama had had dual citizenship: that he was a citizen of both the United States and Kenya.

The Obama website cites the Anneberg Political Fact Check/FactCheck.org statement--which is the position of the Obama campaign, by the way.

“When Barack Obama Jr. was born on Aug. 4,1961, in Honolulu, Kenya was a British colony, still part of the United Kingdom’s dwindling empire. As a Kenyan native, Barack Obama Sr. was a British subject whose citizenship status was governed by The British Nationality Act of 1948. That same act governed the status of Obama Sr.‘s children.

Since Sen. Obama has neither renounced his U.S. citizenship nor sworn an oath of allegiance to Kenya, his Kenyan citizenship automatically expired on Aug. 4,1982.”

For someone involved in a lawsuit over citizenship, admitting that Obama had had dual citizenship at this juncture didn't seem particularly helpful--or likely to quiet those asking questions.

We asked Berg about this.

"The dual citizenship with Kenya--that's a smokescreen. Kenya allows dual citizenship. Kenya is not the issue.

The Obama campaign never mentions Indonesia--and won't. That's a problem. When Obama moved to Indonesia and attended school, he was adopted or acknowledged by Lolo Soetoro; Indonesia didn't allow dual citizenship."

As Berg wrote in his court filing, Berg v. Obama, No. 08-cv-04083.
Obama lost his U.S. citizenship when his mother married an Indonesian citizen, Lolo Soetoro who legally “acknowledged” Obama as his son in Indonesia and/or “adopted” Obama, which caused Obama to become a “natural” Indonesian citizen. Stanley Ann Dunham Soetoro relocated herself and Obama to Indonesia wherein Obama’s mother naturalized in Indonesia. This is proven by Obama’s school record with the student’s name as “Barry Soetoro”, Father’s name: Lolo Soetoro, M.A., and Citizenship: Indonesia.

Hmmm. And what does the Obama campaign have to say about all of this?

Nothing.

One begins to understand why Obama's lawyers chose to file motions instead of producing the documents in question.

Berg: "We got him. The fact that he's not produced any of the documents settles it."

The Elusive Birth Certificate of Barack Obama

Questions come to mind and to us, at least, they seem reasonable.

1. Why won't the Obama campaign provide Obama's birth certificate to a federal judge--who has ordered Obama to do so? Instead, the campaign and the DNC have filed a motion to dismiss that has yet to be ruled upon.

2. Why did the Obama campaign provide digital images of a birth certificate to FactCheck.org that had been altered--either by the campaign or FactCheck.org--and why did FactCheck.org state that the images had never been altered? It was quickly proved that they had been.

3. Why did FactCheck.org have to fact check their own June 12 2008 fact check post on the Obama birth certificate? That is curious behavior for a site that is supposedly a neutral referee on political questions.

4. Why has the Obama campaign fought every attempt--except those carefully controlled by campaign operatives during their interaction with Anneberg Political Fact Check/FactCheck.org--to produce a valid original birth certificate?

5. The document provided FactCheck.org by the Obama campaign very clearly has the following at the bottom: "This copy serves as prima facie evidence of the fact of birth in any court proceeding." Yet, rather than produce that document so it can be examined in a federal court, why has the Barack Obama hired the Council of American-Islamic Relations (CAIR) top "hit man" lawyer to prevent this from happening?

6. Why is it that the document the Obama campaign has shown to FactCheck.org NOT been shown to others in the media--outside a few digital images to friendly MSM papers? There certainly are enough Mainstream Media organizations which double as Obama campaign PR shills--they would be more than happy to pronounce their satisfaction with it.

In reaction to some of the comments left below challenging the veracity of the document, Ben LaBolt, an Obama campaign spokesman, sent the following reaction to The Ticket: "I can confirm that that is Sen. Obama's birth certificate."

See how easy that was to do?

But, apparently, there was too much grumbling among the peasants, so the LA Times had to revisit the issue in August.

Mystery Solved
In Obama's case, there has been rampant online speculation that his birth certificate is forged or altered somehow. Well, the folks at FactCheck.org say they have seen the certificate, touched and vouched it -- Obama is as American as baseball, apple pie and, these days, burritos, pasta and kung pao chicken.

So that should settle it ... unless ... wait ... the people at FactCheck.org use computers, with keypads, that have the letters r-e-z-k-o on them, which just happened to spell the name of one of Obama's disgraced former backers ... and they were in Chicago to see the birth certificate at ... Obama headquarters ... CONNECT THE DOTS, PEOPLE!

Ta da!

Just as FactCheck.org and Politicheck would do in their pieces, anyone with further questions would be labeled as "conspiracy theorists".

Where had we heard that term before?

"Conspiracy theorist" was one of the charges Edwards' supporter leveled at DBKP when we kept writing about the curious facts of the John Edwards affair. Since the National Enquirer hasn't had any stories about Obama's citizenship, "tabloid trash" hasn't been used yet.

Readers may suspect that the traditional Mainstream Media would be no help in all of this--and readers would be right. Just as they did in the John Edwards Scandal, the MSM refuses to fulfill their duties as an adversarial press--unless the candidate is named "Sarah Palin".

Just as CNN, ABC, CBS, NBC, Time, Newsweek, The New York Times, Washington Post and the rest of Big Media refused to investigate the John Edwards affair--no one MSM reporters asked presidential candidate one question for over 10 months about the curious set of circumstances surround him and his mistress, Rielle Hunter--there has been no serious investigation into he growing controversy of the citizenship of Barack Obama.

Other than report what the Obama campaign has given them, the MSM has conducted no investigations. As in the Edwards affair, catch phrases are substituted for investigation.

Two of the favorites must be:

"That's what the campaign is saying? Works for me."

"Conspiracy theorists--bah!"

From FactCheck.org "Has Obama's birth certificate been disclosed?" - June 16, 2008

We asked for and received a copy from the Obama campaign. It is too large to display full size on this page, but you may click on this link to see a copy of the document just as we received it.

FactCheck.org further stated at the time, in a post that could have been written by the Obama campaign itself, "But the document should put to rest groundless speculation raised on some conservative Web sites that Obama might not have been born in the U.S. and therefore might not qualify under the Constitution as a "natural-born citizen" to be president."

The speculation was not based on any evidence. Bloggers raised questions based on the absence of evidence, specifically the lack of a publicly available copy of a birth certificate and the supposed "secrecy" surrounding it. For example, the conservative World Net Daily posted a June 10 article with the headline, "Is Obama's candidacy constitutional?; Secrecy over birth certificate, demand for 'natural-born' citizenship cited." Soon after, some of our readers began asking us the same thing.

The "secrecy" ended when Tommy Vietor at the Obama campaign sent a message to us and other reporters saying, "I know there have been some rumors spreading about Obama’s citizenship, so I wanted to make sure you all had a copy of his birth certificate." A digital image was attached.

Hawaii state law forbids the release of birth or marriage certificates to anyone but the persons named in the documents or their immediate relatives. This copy carries a date stamp of "Jun 6 - 2007" (which has bled through from the reverse side), and is, therefore, probably a copy obtained by Obama himself at that time.

In early June, various PUMA members contacted DBKP and asked us to look into the Obama birth certificate charges. We had just finished debunking Larry Sinclair, the man who had accused Barack Obama of sharing sex and cocaine in the back of a rented limo. [DBKP Library of Larry Sinclair stories]

On June 12, DailyKOS released its now-infamous forgery of what it claimed was Obama's birth certificate.

The KOS document was not only was a forgery, it was a bad one.

On June 16 the FactCheck.org piece appeared. At that time, we hastily concluded that the Obama Birth Certificate story should be assigned to the "rumor" category. Several conservative sites that we trust made the same judgment.

As was stated, we were hasty.

But others were not.

Particularly, Atlas Shrugged's Pam Geller and Yid with Lid.

Geller contacted a document fraud expert who ran a variety of tests on the FactCheck images. The Atlas piece raised so many valid questions about the digital image that the Obama campaign had initially provided, FactCheck fact checked itself--almost immediately after Obama returned from his vacation to Hawaii--and posted other images of the elusive birth certificate at FactCheck.org on August 21.

FactCheck.org began the strangely-worded post (which was updated on August 26):

In June, the Obama campaign released a digitally scanned image of his birth certificate to quell speculative charges that he might not be a natural-born citizen. But the image prompted more blog-based skepticism about the document's authenticity. And recently, author Jerome Corsi, whose book attacks Obama, said in a TV interview that the birth certificate the campaign has is "fake."

We beg to differ. FactCheck.org staffers have now seen, touched, examined and photographed the original birth certificate. We conclude that it meets all of the requirements from the State Department for proving U.S. citizenship. Claims that the document lacks a raised seal or a signature are false. We have posted high-resolution photographs of the document as "supporting documents" to this article. Our conclusion: Obama was born in the U.S.A. just as he has always said.

"Meets all of the requirements from the State Department for proving U.S. citizenship".

Odd choice of wording, but maybe not.

The FactCheck.org post continued in an unusual vein--for a site in the business of checking facts. The post was one part fact, one part sleight-of-hand, one part folksy pablum and one part hurling names at those who has raised reasonable questions on this matter.

The certificate has all the elements the State Department requires for proving citizenship to obtain a U.S. passport: "your full name, the full name of your parent(s), date and place of birth, sex, date the birth record was filed, and the seal or other certification of the official custodian of such records." The names, date and place of birth, and filing date are all evident on the scanned version, and you can see the seal above.

There's that passport thing again.

Is this going to be the line of argument the Obama campaign takes in the future?

The document is a "certification of birth," also known as a short-form birth certificate. The long form is drawn up by the hospital and includes additional information such as birth weight and parents' hometowns. The short form is printed by the state and draws from a database with fewer details. The Hawaii Department of Health's birth record request form does not give the option to request a photocopy of your long-form birth certificate, but their short form has enough information to be acceptable to the State Department. We tried to ask the Hawaii DOH why they only offer the short form, among other questions, but they have not given a response.

The scan released by the campaign shows halos around the black text, making it look (to some) as though the text might have been pasted on top of an image of security paper. But the document itself has no such halos, nor do the close-up photos we took of it. We conclude that the halo seen in the image produced by the campaign is a digital artifact from the scanning process.

We asked the Obama campaign about the date stamp and the blacked-out certificate number. The certificate is stamped June 2007, because that's when Hawaii officials produced it for the campaign, which requested that document and "all the records we could get our hands on" according to spokesperson Shauna Daly. The campaign didn't release its copy until 2008, after speculation began to appear on the Internet questioning Obama's citizenship. The campaign then rushed to release the document, and the rush is responsible for the blacked-out certificate number. Says Shauna: "[We] couldn't get someone on the phone in Hawaii to tell us whether the number represented some secret information, and we erred on the side of blacking it out. Since then we've found out it's pretty irrelevant for the outside world." The document we looked at did have a certificate number; it is 151 1961 - 010641.

Fair enough, so far.

But, all of that bowing and scraping to Obama camapign officials took its toll. Time for a little FactCheck.org sneer for any who had the brass to question FactCheck.org's original "fact check"

We also note that so far none of those questioning the authenticity of the document have produced a shred of evidence that the information on it is incorrect. Instead, some speculate that somehow, maybe, he was born in another country and doesn't meet the Constitution's requirement that the president be a "natural-born citizen."

We think our colleagues at PolitiFact.com, who also dug into some of these loopy theories put it pretty well: "It is possible that Obama conspired his way to the precipice of the world’s biggest job, involving a vast network of people and government agencies over decades of lies. Anything’s possible. But step back and look at the overwhelming evidence to the contrary and your sense of what’s reasonable has to take over."

Phillip Berg seemed reasonable to us. What did he have to say about this?

"There's nothing in our system that requires that a candidate must prove his qualifications are true and correct before he or she runs, and that safeguard should be put into our system by law.

"That's one of the reasons why I filed the lawsuit."

"It is possible that Obama conspired his way to the precipice of the world’s biggest job, involving a vast network of people and government agencies over decades of lies."

Although the good folks at Politifact might think the scenario played out that way, we're not much given to conspiracy theories.

Anyone who's spent much time trying to prove their identity after having their driver's license stolen or lost these days, knows that government bureaucrats rarely exhibit the ambition or initiative such a conspiracy would entail.

A much more likely explanation is that most folks do not have a Kenyan father, or an adoptive Indonesian father. Combine that fact with the fact that most bureaucrats are more skilled at looking at checklists than performing document investigation, and it seems very possible mistakes were made.

It only had to happen once; most license renewals are automatic--long as the applicant can show their previous license.

It seemed strange that two organizations--supposedly interested in checking facts-- would show such contempt toward people asking to, well, check some facts. After all, FactCheck.org didn't exactly set the world on fire in its initial fact check.

FactCheck's post then displayed an image of a birth announcement from the August 13 1961 Honolulu Advertiser.

Again, that's nice. But, FactCheck.org knows that the birth announcement, in and of itself, isn't much more than window-dressing.

The following claim was also posted at FactCheck.org: "You can click on the photos to get full-size versions, which haven't been edited in any way, except that some have been rotated 90 degrees for viewing purposes."

However, it didn't take long to prove that this was one "fact" that wasn't, in fact, a fact.

Shown below is a spreadsheet that lists, for each of FactCheck's photo files, the original file name and size, the current file size, the dates that I downloaded each of them, and the percentage of file compression applied to each of the original files.

By subjecting the original set of COLB photos to these extreme percentages of file compression, without also reducing the image sizes, what you get are photos that look as large as the original ones, but are blurry, fuzzy, and totally useless for detecting any detail in them, detail, that someone like myself, just might use to prove that FactCheck intentionally altered their photos and scan image to perpetuate a fraud on the American public.

That seems like curious behavior for a site dedicated to "fact checking", doesn't it?

Others thought so too. It didn't take long until FactCheck.org was again fact checked--and, once again, their facts were found wanting.

More Questions, No Answers

Texas Darlin's concerns was not so breezily dismissed by the FactCheck post. The FactCheck.org image of the newspaper birth announcement came from her site.

FactCheck.org Has New Birth Certificate Story [Update x2] - August 21, 2008.

Interesting, indeed. I have the following questions for Factcheck. Since they are so on-top of this story, I’m sure they have answers:

1. What took the campaign so long to show an actual document to the media?

2. What other media did the campaign offer to show the COLB to, and have any others seen it and touched it, handled and photographed it? Or only Annenberg-owned Factcheck?

3. Why did the campaign go to such trouble to digitally black out the certificate number when it could have stuck a piece of solid black tape over the number, especially since, as Factcheck reported, they were in such a hurry?

4. Why did Janice Okubo tell a reporter that the COLB was ordered “this month” (June 2008 ) if it was ordered in June 2007?

5. Since Factcheck is seemingly in the business of helping the Obama campaign fight smears, did Factcheck ask the campaign about the rumor that Republicans are holding Barry Soetoro’s birth certificate? If so, what was the campaign’s response? If not, why not?

And finally…

6. How did end up getting this access? Did they ask the campaign, or did the campaign offer to show it to Factcheck? The article is mysteriously vague on that point: “FactCheck representatives got a chance to spend some time with the birth certificate.”

Questions a reasonable person might ask, especially 1,2,4 and 6.

DBKP's LBG had a few reasonable observations, "Obama, Bill Ayers, and FactCheck.Org: All Have Ties To Annenberg Foundation:
Again, regardless of whether the certificate is authentic or not, DBKP finds the fact that Obama’s attorney chose to file a motion to dismiss rather than just handing over a certified copy of the birth certificate to the judge puzzling. Everyday ordinary citizens have to prove citizenship by providing a certified copy of their birth certificate in order to obtain a driver’s license or an ID card.

We cannot fathom why the Obama camp chose the motion to dismiss instead of complying with a Federal judge’s order to provide a certified copy of Obama’s birth certificate.

The Obama campaign handed over a copy to Factcheck.org, why the “stall” with handing a copy over to the Federal Judge handling the Berg lawsuit?

If the Obama birth certificate is on the “up and up” then releasing it to a Federal Judge should be a “priority” of the Obama campaign instead of filing “motions to dismiss”. After all, the rest of us ordinary Average Joe’s have to fork over a copy of our birth certificates every now and then to prove we’re citizens in order to get something as mundane as a driver’s license.

We imagine most citizens would comply with a judge’s order to supply a copy of our birth certificate without too much fuss. Obama, an attorney himself, must surely realize the consequences of disobeying a judge’s order.

So why all of the curious behavior: by Barack Obama, the Obama campaign, FactCheck.org and a compliant MSM?

Produce the documents and make the case go away.

Then, Barack Obama can go back promising a chicken in every pot and health care in every garage and less taxes--on the house--for everyone except the evil rich.

DBKP can go back to asking questions about "Just Who Exactly is Barack Obama and why are so many of his past associations shrouded in secrecy and his past documents so difficult to obtain?"

We didn't weigh in on the citizenship issue earlier: we erroneously thought that FactCheck.org was a neutral fact checker.

Oops!

Sure, we know that we'll get swarmed by the usual suspects in the comments section calling us names for noticing these curious behaviors.

We're used to it.

The Edwards minions attacked us from the Left during the months it took the John Edwards story to come out.

During our investigation of Larry Sinclair, we were labeled "Obamabots" (Stop it, you're killing me!) and worse by some on the right.

We're glad that others, like Atlas, Texas Darlin and Yid with Lid, pursued this while we were busy with other stories. But now, we consider these questions of Obama's citizenship--as well as the little-publicized past associations, statements and actions of Barack Obama--to be the story to which we should devote our small resources.

We hope our readers will assist us, as they did with the John Edwards' story: with tips and places for us to look and facts to check.

Is Barack Obama constitutionally qualified to be the President of the United States of America?

We don't know.

But we're going to be asking some questions in the next four weeks.

Beginning with: "Why is Barack Obama not doing what thousands of Americans have to do every day?"

Produce proof of citizenship.
