An interesting turn of events in the federal lawsuit filed by Phillip Berg demanding proof from Barack Obama that he is an American citizen and eligible for the U.S. presidency.

From Jeff Scrieber's America's Right - Berg: Due to Procedure, Obama, DNC Admit All Allegations:

According to Rule 36 of the Federal Rules of Civil Procedure, a party upon whom requests for admissions have been served must respond, within 30 days, or else the matters in the requests will be automatically deemed conclusively admitted for purposes of the pending action.

On September 15, as part of his federal lawsuit contending that the Illinois senator is ineligible, pursuant to the U.S. Constitution, to serve as president of the United States, Philadelphia attorney Philip Berg served Barack Obama and the Democratic National Committee with just such a request. Soon thereafter, on October 6, Barack Obama and the DNC acknowledged service in their motion for protective order, filed in an attempt to persuade the court to stay discovery. The Federal Rules require that a response to a request for admissions be served within the 30-day time limit, and Barack Obama and the DNC have not done so.

Therefore, this morning, amidst news reports that Barack Obama will be suspending his campaign for a few days so he can fly to Hawaii to visit his grandmother, who has suddenly fallen ill, Philip Berg will file two motions in district court in Philadelphia:

* A motion requesting an immediate order deeming his request for admissions served upon Barack Obama and the DNC on September 15 admitted by default, and

* A motion requesting an expedited ruling and/or hearing on Berg’s motion deeming the request for admissions served upon Obama and the DNC admitted.


Schreiber explains what this all means in the story at his site.

He does note:

Unless permitted by the court or allowed pursuant to a written agreement between the parties, the party served with the request must serve a response within 30 days. How serious is a failure to respond? This, from PreTrial, by Thomas A. Mauet:

The automatic provision of Rule 36 makes it a formidable weapon because inertia or inattentiveness can have an automatic, and usually devastating, consequence. Hence, there is one cardinal rule for practice under this provision: Make sure you respond and serve the response within the 30-day period.

We're not sure why the Obama team did not file the necessary papers in time.

Schreiber, who's a straight shooter in his reporting ends his long and informative post with a quote from Berg on the significance of the non-action.

"It all comes down to the fact that there's nothing from the other side," Berg said. "The admissions are there. By not filing the answers or objections, the defense has admitted everything. He admits he was born in Kenya. He admits he was adopted in Indonesia. He admits that the documentation posted online is a phony. And he admits that he is constitutionally ineligible to serve as president of the United States."

Two weeks before the election and things are going to be interesting.

Another lawsuit has been filed seeking information over the citizenship of Barack Obama. This time in the Seattle area.

A man from the state of Washington has filed a lawsuit in King County Superior Court asking Washington Secretary of State Sam Reed to obtain proof from Barack Obama of U.S. citizenship or remove Obama's name from Washington presidential ballots.

Steve Marquis, of Fall City, WA, filed the suit yesterday and issued a press release.

He argues in a 30-page document:

“To avert likely civil unrest and a constitutional crisis…this complaint seeks to resolve such complaints prior to the election. It was incumbent on the candidates to present such documentation, but to date Mr. Obama has failed to do so.

Obama sought to put down this pesty rumor when he posted a picture of his birth certificate online here.


The report cites the Annenberg FactCheck.org conclusion that Obama was a citizen.

The report continues, "Reed forwarded the matter to the Attorney General’s Office. Ballots are still slated to be mailed this week."

Another rumor which made the rounds was that of Joe Biden leaving the Democrat ticket "sometime after October 5 due to health reasons."

That rumor has been laid to rest by the passage of time: ten days after the date it was supposed to happen, Biden is still doggedly on the campaign trail. DBKP reported both the rumor and the dearth of Obama-Biden campaign material available nearly a month after Biden was selected to the Democrat ticket.

The issue of Obama's citizenship has been alive much longer--since the spring of 2008. That the Obama campaign chose to address it in a less-than-forthcoming way causes people to ask questions.

The fact that Barack Obama has chosen not to release medical, college or university records has also raised questions.

Questions which might easily be answered with the release of records which many Americans have to cough up in order to secure employment.

The longer these records remain hidden from the public's view, the more questions--and now, lawsuits--will be initiated.

Why the Obama campaign has not released the records with less than three weeks until the election remains a mystery.

The decision by Obama to fight the federal lawsuit of Phillip Berg, instead of providing documents also raises eyebrows.

Add all of this to the fact that Barack Obama first dodged, then downplayed and finally mis-characterized his relationship with domestic terrorist, Bill Ayers, and you have a recipe for suspicion.

Those suspicions are only increased by the absence of the Obama records.

None of this bothers Obama supporters, but in absence of any legislative record to examine, without the records, there is precious little on which to judge Barack Obama--other than his political speeches and his endorsement by the Mainstream Media.

Perhaps the plan of the Obama campaign is to distract detractors from questions about Obama policies?

If that is true, their plan may be working to some extent.

Time will tell.

Mark Steyn got it exactly right about Ahmadinejad's NYC visit during his weekly interview on the Huge Hewitt show on Townhall.com.
MS: I think the correct attitude to these things is a very simple one. Under the agreement by which the United Nations sits in New York City, the United States cannot deny entry to any foreign head of state. That being so, he should land at the airport, he should go directly to the United Nations, and no state or municipal or other officials should offer him these courtesies in any way. This would be a disgusting photo op that he would use to his advantage back home. And the City of New York should not be cooperating with him.
Steyn gives Mitt Romney a plug concerning Romney's stand against a previous Iranian President.
MS: That’s right. If he wants to see the results of Islamist terrorism, there are a lot of places he can visit much nearer to home. In fact, Mitt Romney, one of the best things he ever did was to deny the state troopers protection facility to Ahmadinejad’s predecessor when he was invited to speak at Harvard. And Mitt Romney had the right line on this. If Harvard wanted to issue these idiotic invitations, that’s up to them. But the taxpayers of Massachusetts are not going to fund the visit by providing protection for these guys. And in the end, the event was cancelled. And that’s exactly the line that the state of New York should be taking, too.

Ordinary Americans will be shocked to discover there are officials in NYC who see nothing wrong with giving Ahmadinejad a key to the city. It's up to those same ordinary Americans to let New York City know exactly how they feel.

In a world of perfect karma, Ahmadinejad would be captured by American "students" and held hostage for over a year, paraded before TV cameras and threatened almost daily with death.

By now, everyone knows their parts: Iranian is captured by U.S. forces in Iraq, Iran issues denials, the Europeans and the UN will issue calls "to remain calm" and more Americans fighting in Iraq will die.
US-led forces in Iraq say they have arrested an Iranian officer operating in the north of the country.
They say the man was a member of the Quds Force - an elite unit of Iran's Revolutionary Guards - and was detained in the Kurdish city of Sulaimaniya.

"This individual has been involved in transporting improvised explosive devices," the American military said.

It's perfectly OK for Iran to be operating in Iraq trying to kill American soldiers--if they had the balls to declare war. Since they don't, it's only fitting that the 'cowboys from the U.S.' do it for them. And do it before they become nuclear-armed.

It's time to check in on Duane Chapman and Dog the Bounty Hunter.

Less than a month until New Dog the Bounty Hunter

The new shows debut on Wednesday, July 16 on A & E Network.
Dog the Bounty Hunter,” a reality TV series that follows the unruly activities of Duane “Dog” Chapman, is returning to the air after its indefinite cancellation last November. Fans will be able to hear the beloved strains of “I’ll hunt you down, cause I‘m the dog” when the show continues with a brand new series on Wednesday, July 16.


The show, which is aired on the A&E network, chronicles the life of bounty hunter and bondsman Chapman who resides in Honolulu. Events of previous episodes have included his work in tracking and capturing bail jumpers and occurrences in his family relationships.


July 16 can't come soon enough for the legion of Dog fans.




DTBH Producers Sued by Actor

A Russian-born actor, Boris Krutonog, who says he created Dog the Bounty Hunter, has sued the show's producers for at least $5 million. Krutonog claims that he's owed compensation for royalties, salary and other considerations.

Krutonog also complains in court papers that he was the target of "abusive, violent and outrageous conduct" and "episodes of psychotic behavior by" the show's stars, Duane "Dog" Chapman and his wife Beth. Court papers say that he introduced himself to "Dog" Chapman in 1995. Believing that Chapman's colorful life and exploits could be the basis of a movie or a TV show, Krutonog signed contracts with Chapman and received the exclusive right to develop the program. Between 1995 and 2003, Krutonog alleges that he developed what became Dog the Bounty Hunter. The papers noted that A&E agreed to pay him as co-executive producer "for the life of the program" in order to obtain Krutonog’s consent to produce and air the show.




TV Dog Feuds on TV for Charity

Dog and members of his family will match up with Cathy Lee Gifford on Celebrity Family Feud for charity.

Family Feud goes Hollywood with an all-new celebrity edition of the classic game show, premiering Tuesday, June 24 at 8 p.m. ET/PT on "A". Hosted by Al Roker, Celebrity Family Feud is a star-studded version of the beloved game show, only this time 24 famous families will face off and throw down for the charity of their choice. Former TV Queen Kathy-Lee Gifford goes head-to-head with Dog the Bounty Hunter, the casts of My Name is Earl and The Office fight for first place and Deion Sanders tries to keep up with the Kardashians.


Dog and his bounty hunter family will be only one star-studded match-up. The line-up consists of:

As fans well know, DTBH was pulled from A&E's lineup last November after a private cellphone conversation was sold by his son to the National Enquirer. The Enquirer released the tape which contained racial slurs.

In May, A&E announced that the show would return, with assurances that Chapman had taken the necessary efforts in receiving forgiveness from those who had been affected by his racist comments. A statement from the network explained, “Since the premise of Dog the Bounty Hunter is about second chances, we have decided to give him one.”


Before the show's suspension, the program was the network’s highest rated series.

Looks like Duane Chapman is making the most of his second chance, which for fans and Chapman alike, begins on July 16

Gays Hijack "Lesbians"; Isle of Lesbos Residents Sue

Three islanders from Lesbos told a court Tuesday that gay women insult their home's identity by calling themselves lesbians.



The plaintiffs—two women and a man—are seeking to ban a Greek gay rights group from using the word "lesbian" in its name. Also known as Mytilini, Lesbos was the home of the ancient poet Sappho, who praised love among women.

It is a major travel destination for gay women. The Homosexual and Lesbian Community of Greece "causes confusion by using a geographic term in connection with (the group's) special character and social action," said Dimitris Papadelis, a lawyer representing the plaintiffs. A spokeswoman for the group accused the plaintiffs of homophobia.

"I believe ... the other party's intentions were purely racist," Evangelia Vlami said.
"They showed that what bothers them is a specific sexual orientation."

"What will they do next, sue the United Nations? They, too, use the term lesbian," Vlami said. Plaintiff Dimitris Lambrou has insisted the lawsuit "is not an aggressive act against gay women." Lawyers from both sides are to submit written arguments on Wednesday, and the court is expected to issue its decision in the next six months.

Savage Legal Nation Vs. C.A.I.R. Showdown



Michael Savage takes to the airwaves daily during his popular talk show "Savage Nation". Now, Savage will be taking it to the courts to stop copyright infringement against a familiar adversary.
Savage has filed a copyright infringement lawsuit against the Council on Islamic-American Relations, and has accused the organization of being a "political vehicle of international terrorism" that seeks to do "material harm to those voices who speak against the violent agenda of CAIR's clients."

The lawsuit, filed in U.S. District Court in California, seeks damages equal to the ongoing donations from CAIR supporters "who expect CAIR to act in this manner in exchange for continuing financial support" as well as "actual damages according to proof."
Anyone familiar with CAIR knows that the organization is familiar witht the American legal system. CAIR has famously filed suits against bloggers who disagree with their views.

CAIR has yet to emerge victorious in the courts, but the legal expenses incurred by bloggers many times serve to dampen criticism of the Hamas-connected front group.

Now, CAIR is on the receiving end of a suit and it will be interesting to see if their uninspiring legal won-lost record is improved.
A spokesman for Savage indicated the top-rated talk show host would have no further comment, saying the text of the lawsuit itself would answer questions.

The focal point of the lawsuit is a series of audio clips CAIR has been using in its promotions and fundraising efforts.
There's no love lost between either Savage or CAIR.

"I'm not gonna put my wife in a hijab. And I'm not gonna put my daughter in a burqa. And I'm not getting' on my all-fours and braying to Mecca. And you could drop dead if you don't like it. You can shove it up your pipe. I don't wanna hear any more about Islam. I don't wanna hear one more word about Islam. Take your religion and shove it up your behind. I'm sick of you."

Savage vs. CAIR. If it was a TV special, it would acheive "must-see" status in many homes.

Savage is over-the-top and unabashed in his views, while CAIR is no less over-the-top, though somewhat more sly in expressing their views.

You just knew it was coming.

In an America where someone sues when they spill coffee in their own lap, it was only a matter of time.

Duane "Dog the Bounty Hunter" Chapman will be the target of a lawsuit by his son Tucker's girlfriend, Monique Shinnery. She said she plans on filing soon.

The victim of Duane "Dog the Bounty Hunter" Chapman's racist rant announced today that she plans to sue him.

Monique Shinnery, who was repeatedly called "n----r" by Chapman on tape told The National ENQUIRER: "I'm going to sue Dog Chapman."

Chapman not only subjected her to racist slurs, but he also attacked her character in subsequent TV interviews, even though he had never met or spoken to her.

His public attacks on her character pushed Monique over the edge.

As he attempts to save his TV show, Chapman has appeared on two national TV shows offering tearful - and at times bizarre apologies - for using racist slurs. But he has continued to damage Monique's reputation while trying to dig himself out of trouble, she told The National ENQUIRER.

"I want justice," Monique told The National ENQUIRER. "He has slandered me, stated that I have bad character and repeatedly lied about me on national television. If I'm ever going to hold my head up in public again, I need to stand up for what is right."

In March, Dog used the "N" word over and over again while demanding that his son, Tucker, dump Monique, his girlfriend of seven months, if he wants to be part of the Chapman family. The conversation reached the outraged ears of the world when The National ENQUIRER exclusively released the venomous, racist tapes, and caused A&E to drop Dog's show from their schedule "for the foreseeable future." A&E has refused to cancel the show, its top moneymaker.

Chapman has apologized for using the "N" word, but he has tried to keep the focus off the fact that he said he did not want a black person in his house or in his family.

In his first written and public apology, Chapman, who had never met, nor seen, Monique, said, "I was disappointed in his choice of a friend, not due to her race, but her character."

"Dog Chapman knows nothing about my character," Monique, 21, who has no criminal record, works with mentally challenged children and hopes to enlist in the Coast Guard, told The National ENQUIRER. "He doesn't know me, and he has never met me.

"I have had threats from his fans. I have been hiding, afraid to go out. After Dog's slander against me, my boss told me they might require that I take a drug test. I have never done drugs.

"Dog said on television that I had a plan to jump (his wife) Beth and hoped to tape her using racial language. He said he saw me and another girl in a car outside his shop, wearing tank tops.

"I never wear a tank top, I have never been in that parking lot when they were at their bail bond shop and I certainly wouldn't jump Beth. I weigh 105 pounds! She'd kill me!

"It was all lies. He 'apologizes' and then continues to lie about me. I cannot and do not accept his apology, because it was insincere.

"It's not even about him using the 'N' word. It's about him not wanting a black woman to be part of his family or part of his son's life.

"They use the 'N' word all the time. Once, Beth said to Tucker, 'If you want to smoke, you can go over to your n----r girlfriend's house and smoke.' Beth's as much of a racist as Dog is.

"Tucker and I were talking with Baby Lyssa (Dog's daughter) one time and she said, 'N----rs,' and quickly changed it to 'black people' when she realized I was listening. Their family is just like that.

German, 77, Man Sues Girl, 19
For Not Going To Bed With Him

Something light before breakfast this morning. From the pages of that esteemed German periodical, Der Spiegel comes news that old rich horny guys have one more weapon in their battle to conquer the young and stretchless.
Aging German playboy Rolf Eden has rarely taken no for an answer. And he's not about to start. He has filed charges against a 19-year-old for refusing to sleep with him. The complaint? Ageism.

It's no secret that Germany has a problem with ageism. Workers here who lose their jobs after the age of 50 are virtually assured of spending the rest of their lives on the dole. A recent plan to up the retirement age to 67 was lampooned because most Germans of that age are no longer employed anyway.

But aging German playboy Rolf Eden seems to have developed a somewhat warped view of what age discrimination actually is. According to Bild Zeitung on Thursday, the 77-year-old Eden has filed suit against a 19-year-old Berlin woman for the following reason: Despite a night on the town with Eden, which ended back at his place, she refused to have sex with him, saying the he was too old for her.

"That was shattering. No woman has ever said that to me before," Eden told the tabloid. "I was crushed." He has filed charges with the prosecutors' office, he said. "After all, there are laws against discrimination."
The story goes on to relate the number of women Rolf has been with and that he was apparently quite the Man-About-Berlin in the 1950s and 1960s.

And geezers everywhere are now reaching for their lawyer's number.

Some people always cry at weddings; others always file--a lawsuit, that is.
NY Post:
A rose by any other name would smell as sweet, but hydrangeas of the wrong color allegedly stank up a Manhattan couple's wedding.

Elana and David Glatt have filed a $400,000 suit against an Upper East Side florist, charging it caused them "extreme disappointment, distress and embarrassment" on what was supposed to be the greatest day of their lives by providing the wrong-colored hydrangeas for their Aug. 11 nuptials.
You may now sue the bride.
